Terms and Conditions

The Terms and Conditions below govern the sale of goods from Winston Engineering Corporation (Pte) Ltd  (“Winston Engineering” “We”, “Us”, “Our”) on  www.winstonengineering.com  (“the site”) to you (“Customer” “You” “ Your”).

1. General

The validity, legality or enforceability of any part of these Terms and Conditions will be unaffected by the invalidity, illegality or unenforceability of any individual part of these Terms and Conditions. The Terms and Conditions shall be governed by and interpreted in accordance with Singapore Law. All pictures displayed are a mere representation of the product and may vary from the actual product.

2. Site Use

2.1 The Customer is responsible for maintaining the confidentiality of his/her account and password and for restricting access to his/her computer, and the Customer agrees to accept responsibility for all activities that occur under his/her account or password. Winston Engineering reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

2.2 The information on this site is provided on an “as is” basis. To the fullest extent permitted by law, Winston Engineering:

• Excludes all representations and warranties relating to this site and its contents or which is or may be provided by any affiliates or any other third party, including in relation to any inaccuracies or omissions in this site and/or Winston Engineering’s literature; and
• Excludes all liability for damages arising out of or in connection with your use of this site. This includes, without limitation, direct loss, loss of business or profits (whether or not the loss of such profit was foreseeable, arose in the normal course of things or the Customer have advised Winston Engineering of the possibility of such potential loss), damage caused to the Customer’s computer, computer software, systems and programs and the data thereon or any other direct or indirect, consequential and incidental damages.

2.3 Unless otherwise stated, the products on this site are only available within Singapore, or in relation to postings from Singapore. All advertising is intended solely for the Singapore market. You are solely responsible for evaluating the fitness for a particular purpose of any downloads, programs and text available through this site. Redistribution or republication of any part of this site or its content is prohibited, including such by framing or other similar or any other means, without the express written consent from Winston Engineering. Winston Engineering does not warrant that the service from this site will be uninterrupted, timely or error free, although it is provided to the best ability. By using this site, you thereby indemnify Winston Engineering, its employees, agents and affiliates against any loss or damage, in whatever manner, however caused.

3. User Account

By signing up as a member, the Customer is responsible for maintaining the confidentiality of his/her account and password and for restricting access to his/her computer, and the Customer agrees to accept responsibility for all activities that occur under his/her account or password. Winston Engineering reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.

4. Pricing and Ordering

4.1The price payable for the goods is as indicated on the site when Customer places their order.

4.2 Winston Engineering reserves the right to update product prices at any time without prior notice.

4.3 Winston Engineering reserves the right to refuse or decline to accept any order.

4.4 If the actual price of any product ordered by Customer is higher than that reflected on the site, we will inform you and you may consider if you would like to confirm, cancel or substitute your purchase of such product based on the correct price.

• 4.4.1 Should you confirm or substitute your purchase, you authorise us to charge the additional amount or refund the balance should the substitute be of lower cost to you.
• 4.4.2 Should you choose to cancel your purchase, we will refund payment (for paypal, only) for such product in accordance with our refund policy (refer to clause 12).

4.5 Once ordered, no order may be cancelled or reduced in quantity. Orders are accepted by Winston Engineering by the dispatch of products, however, that dispatch does not constitute acceptance where the price of the supplies has been incorrectly quoted or referenced by the Customer in its order.

4.6 Winston Engineering reserves the right to accept or reject requests for order cancellations at its sole discretion. If we receive a cancellation request and the order has not been processed, we will cancel the order. We are not able to cancel orders that have already been processed or delivered. Winston Engineering, at its sole discretion, may decide whether an order has been processed or not.

4.7 For PayPal payments, products will be paid for at the point of order. In the event that products have to be backordered or are not available, the Customer will be given the option to cancel the order. Upon cancellation, the money will be refunded within 14 working days depending on whether it has already been processed.

5. Payment Term

5.1 Payment may be made as follow:

5.2 If Customer fails to make payment successfully, Winston Engineering shall be entitled to:

• Cancel the order

5.3 Winston Engineering reserves the right to charge for copy invoices or where the original has been lost or misplaced by the Customer.

5.5 If legal action is taken to mitigate or resolve any payment discrepancies, Customer shall reimburse to Winston Engineering all legal and disputed costs and expenses incurred.

6. Mode of Delivery

6.1 There is only Self-Collection option for all orders made.

6.2 Upon receipt of the Sales Order and the Sales Order is accepted, we will send you an email confirmation. The Goods ordered will not be immediately available for collection. We will contact you once the item is ready for pick up during our office working hours.

6.3 Please notify Winston Engineering immediately of any change to your date or time of collection, or contact number. 

6.4 We will send you a reminder to your email address if the Goods are not collected within 7 days from the date on which the Goods are ready for collection. If you still do not collect your purchases within 14 days from the date of the reminder, we may impose storage and administration charges at Winston Engineering's prevailing rates. Winston Engineering Corporation (Pte) Ltd reserves the rights not to entertain the collection or fulfill the Sales Order should the Goods remain uncollected after 2 months from the date the Goods were ready for collection and to return you any monies paid less the storage and administration charges and/or to claim against you for any balance outstanding administration and storage charges.

7. Tax Charges

All prices are subjected to Goods & Services Tax of 7% (GST). It will be effective along with the latest changes according to the government direction if any.

8. Exchange / Returns

We ask that customer check their orders upon collection. All  goods  sold are  non-exchangeable and  non-refundable. Unless otherwise stated below. We strictly do not accept change-of-mind returns or exchanges - there are no exceptions to this. 

8.1 If product(s) are found defective, please contact us within 7 days of collection date at marketing@winstonengineering.com or call us at 6863 3338. Please provide us with the relevant documentation required (e.g. invoice, picture if the defect is visible and a description of the issue) to be send over to Winston Engineering. Upon verification that there indeed is a manufacturing defect, we will suggest an exchange at no additional cost or refund your payment.

*Defects exclude breakage and/or wear and tear from regular usage.

9. Liability

9.1 All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act) are, to the fullest extent permitted by law, excluded from all orders by the Customer. Winston Engineering does not however exclude liability for death or personal injury caused by its negligence. The above exclusions and limitations apply only to the extent permitted by law. None of your statutory rights as a consumer are affected.

9.2 Notwithstanding any other provisions, Winston Engineering’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the contract shall be limited to the contract price; and Winston Engineering shall not be liable to the Customer for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the contract.

10. Warranty

10.1 Winston Engineering will endeavour to transfer to the Customer the benefit of any warranty given by the manufacturer of the products. Simply drop an email to  marketing@winstonengineering.com

10.2 In addition, Winston Engineering will see to any repair or replacement proved to be of reasonable satisfaction of Winston Engineering to be defective. This obligation will not apply:

• If the defect arises because the Customer has altered or repaired the products without the written consent of Winston Engineering
• Because the Customer did not follow the manufacturers’ instructions for storage, usage, installation use or maintenance of the product

10.3 Any replacement product(s) or replacement made will be guaranteed on these terms for any unexpired period of guarantee given on the original products. The replaced product(s) will belong to Winston Engineering.

10.4 The Customer grants Winston Engineering a right to enter into its premise to affect any repair or replacement. The Customer shall ensure that Winston Engineering’s employees and representatives are provided with a safe and secure working environment while at its premises.

12. Refund Policy

Customer can email us at  marketing@winstonengineering.comwithin 14 days from self-collection for any request for refund if permissible.

12.1 Refund is allowed if:

I. Order has not been processed;

II. When product is out of stock and requires a long lead time unacceptable by the Customer.

12.2 Refund will be made to Customer within 30 working days upon receiving products accepted for exchange (if applicable) by Winston Engineering. The refund will be made to your Paypal account depending on mode of payment.

 13. Force Majeure

Winston Engineering shall have no liability to the Customer for any failure or delay in supply or delivery or for any damage or defect to the goods supplied or delivered caused by any event or circumstance beyond Winston Engineering’s reasonable control.

14. Governing Law and Jurisdiction

The law governing the use of Site and all transactions is the Law of Singapore. Any aspects that are not covered by these Terms and Conditions are subject to Singapore Law.

15. Salvatory Clause

If any of these Terms and Conditions is rendered invalid or void, the other Terms and Conditions will remain in fact.

16. Acceptance of these terms

You acknowledge that you have read this Agreement and agree to all its terms and conditions. By using the Site or its Services you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Site and its Services.
